LCSO Responds to Alleged Assault Call & 3 People Reportedly Injured

On January 10, 2022 about 6:07 p.m. Law Enforcement Center E-911 Dispatch received multiple calls requesting law enforcement and emergency medical response to a residence in the 12000 block of LIV 216.

Livingston County Sheriff's Office (LCSO), Missouri State Highway Patrol (MSHP) and Chillicothe Department of Emergency Services responded to the scene.

Initial investigation shows an adult male prohibited from being at the residence due to active Court Order Ex-Parte Protection Order had been in the home.  The other person in the protection order was not home at the time.  That person's parent and step-parent reportedly went to the home to search for the above male.  At some point at least one of these two people were armed with a ball bat and confronted the male in the basement area of the home.  The reported information on what happened next remains under investigation but the three people requested to go to the hospital for their apparent or alleged injuries.  

CDES had sent two ambulances to the scene and their staff was extremely helpful.  The scene was processed and additional interviews took place. 

Daniel Joseph Smith, 34, Chillicothe, was arrested for 2 counts alleged Violation of a Full Order of Protection-Adult and transferred to the Daviess Dekalb Regional Jail.  Mr. Smith was charged in Livingston County Associate Court today with the 2 alleged violations and remains incarcerated in lieu of bond.

Additional investigation is taking place with the potential of additional charge(s) to follow against one or more people.

All Ex-Parte Orders of Protection should be respected and followed by the petitioners and respondents.
